Reverse Engineering not an Inalienable Right
Nimmer has a good posting today which makes the seemingly obvious point that one ought to expect contractual prohibitions on reverse engineering to be enforceable. Not all cases agree, and there is a lobby that would elevate the right to reverse engineer to inalienable status. Check out his article here.
